Latest national poll spells more trouble for Biden, shows him trailing all 3 top GOP candidates
A new national poll released Wednesday showed President Biden trailing all three lead GOP presidential candidates: former President Donald Trump, Florida Gov. Ron DeSantis and former U.N. Ambassador Nikki Haley.
According to the survey, conducted this month by Marquette Law School, Trump has an advantage of 52% to 48% over Biden among registered voters while DeSantis holds a 51% to 49% advantage in a head-to-head matchup with the president. And Haley, who also previously served as governor of South Carolina, holds a 55% to 45% edge over Biden, the largest lead among Republican candidates.
The survey showed that Trump’s edge over Biden has grown considerably since July when Marquette’s poll showed the pair tied at 50%. It further showed DeSantis’ lead over Biden has remained consistent in that same time span.
And while all three of the top Republican candidates lead Biden, Trump is the only one who leads among Independent voters. Haley, meanwhile, has the largest support among Democrat voters compared to Trump and DeSantis.
FOX NEWS POLL: SUPPORT FOR TRUMP HITS 62% IN GOP PRIMARY
Trump has an edge of 54% to 46% over Biden among independents. Biden leads DeSantis 53% to 47% and Haley 51% to 49% among Independents.
At the same time, Haley draws the support of 15% of Democrat voters while Trump gets 11% and DeSantis gets 8%.
In addition, the Marquette poll showed Trump, for the first time this year, has taken a lead among registered voters who report being reluctant to choose either him or Biden. Trump leads Biden in that category by a margin of 53% to 47%, a big shift from Biden’s 55% to 42% lead as recently as September.
The most recent poll comes as the White House continues to claim it is not concerned about polling, which continues to show Biden’s approval rating falling and his 2024 prospects waning.
“I mean, look, I spoke to this yesterday,” White House press secretary Karine Jean-Pierre told reporters this month. “And what I said is you have to take these polls … with a grain of salt, right? And I talked about 2020 … and what we saw in 2020 and what was being reported then. And what we saw is a president that was … able to bring an incredibly strong, diverse coalition to win in 2020. We saw the same thing in 2022.”
“So, look, we don’t put much stock in … polls,” she continued. “The president is going to focus on delivering for the American people. He has an agenda that is incredibly popular, and that matters. And that’s going to be what the president is going to focus on: How do we continue to deliver for the American people? And that’s the focus.”
Democrat strategists, though, warned that Biden’s poor polling performance shouldn’t be overlooked.
“I want [Biden] to consider what is best in terms of the goal that I know he is committed to, which is defeating Donald Trump,” David Axelrod, a former senior Obama campaign adviser, told CNN’s Wolf Blitzer on Nov. 6.
“And if he believes, based on not just what [is] in his heart but what’s in the data and what he’s being told that he has the best chance to do it, then he should run. But you know, the thing that irritates me a little bit, Wolf, is this notion that people who are concerned are ‘bedwetters.'”

DOJ seizes record $1 billion counterfeit goods haul
The Department of Justice (DOJ) seized counterfeit goods worth about $1.03 billion and charged two people with trafficking in fake merchandise.
The U.S. Attorney’s Office for the Southern District of New York, along with the New York Field Office of Homeland Security Investigations and the New York Police Department, announced the seizure Wednesday.
It involved “approximately 219,000 counterfeit bags, clothes, shoes, and other luxury products with a total estimated manufacturer’s suggested retail price (‘MSRP’) of approximately $1.03 billion,” per a news release from the U.S. Attorney’s Office.
Adama Sow, 38, and Abdulai Jalloh, 48, face charges of trafficking in counterfeit goods, according to the release. The charge carries a maximum sentence of 10 years in prison.
Officials allege the men ran counterfeit goods trafficking operations on a wide scale from a storage facility in Manhattan from January to October, according to the release. Jalloh is alleged to have had another location at which he trafficked goods in Manhattan, officials said.
“As alleged, the defendants used a Manhattan storage facility as a distribution center for massive amounts of knock-off designer goods,” Damian Williams, U.S. attorney for the Southern District of New York, said in a statement.
“The seizures announced today consist of merchandise with over a billion dollars in estimated retail value, the largest-ever seizure of counterfeit goods in U.S. history,” Williams continued.

Sen. Graham proposes legal route to overturn Pentagon abortion policy as military promotions remain in limbo
FIRST ON FOX: Sen. Lindsey Graham, R-S.C., is proposing a legal route to overturn the Pentagon’s abortion policy as Alabama Sen. Tommy Tuberville continues his blockade on hundreds of military promotions.
Graham tapped conservative attorney Jay Sekulow for legal advice. Sekulow is “confident” a lawsuit could be brought against the Department of Defense.
“This is a use of funds that’s prohibited by law,” Graham told Fox News Digital in an interview Thursday. “And certainly was never authorized by the Congress, and Jay is a pretty smart guy. He thinks that there’s a great chance of success in the courts.”
Graham will need the support of House Speaker Mike Johnson, R-La., to bolster momentum in court. The main argument, Graham said, is that the policy violates the 1976 Hyde Amendment, which prohibits the use of federal funds to pay for abortion services except in cases of rape, incest or when the life of the mother is at risk.

Additionally, the provision was implemented without Congress’ approval after Roe v. Wade was overturned last year.
Graham is optimistic a court battle could bring a bigger return for the GOP, claiming it “may pay dividends down the road.”

“I think the student loan provisions that were struck down, that was court action that reined in the Biden administration,” Graham said of the Supreme Court’s rejection of President Biden’s student loan forgiveness plan in June. “I think the court action here could rein in the Biden administration [again].”
The other avenue, Graham said, may be through the military defense spending bill known as the National Defense Authorization Act, which Congress has to agree on by the end of December.
The House’s version, which passed earlier this year, dismantled the abortion policy in its text, along with other hardliner GOP issues like transgender procedures for service members. But it’s unlikely the Democrat-controlled Senate will agree to pass the lower chamber’s package.
“I don’t agree with the abortion decisions, using taxpayer money to pay for abortion travel, but military officers who are being denied promotions had nothing to do with this,” Graham said.
SENATE DEMOCRATS ADVANCE MEASURE TO CIRCUMVENT TUBERVILLE’S MILITARY HOLDS
Tuberville’s protest, sparked by the Department of Defense reimbursing service members who receive abortion procedures, has been unwavering for nearly nine months.
The Democrat-led rules committee passed a resolution this week to override his objection and get promotions to the Senate floor. Nine Republicans will have to vote alongside Senate Democrats to get the motion across the finish line.
Despite his opposition, Graham said he wouldn’t vote with the Democrats.
“I am prepared to find off ramps without having to change the structure of the Senate,” Graham said.
Sen. Minority Leader Mitch McConnell, R-Ky., who sits on the Senate Rules Committee, also voted against the resolution Tuesday, even though he has previously voiced his skepticism of Tuberville’s holds.
Whether Tuberville is on board to trade his objection for legal action is yet to be seen. So far, he’s been unrelenting, even after a handful of GOP lawmakers — including Graham; Todd Young, R-Ind.; Dan Sullivan, R-Alaska; and Joni Ernst, R-Iowa — took to the floor after midnight until nearly 4 a.m. Thursday to rail against his blockade.
In a statement to Fox News Digital, Tuberville’s office said, “Coach is exploring all feasible options to end the Pentagon’s illegal and immoral policy.”

Judge in Trump’s Georgia election interference case orders ‘sensitive’ evidence withheld from public
The judge overseeing former President Donald Trump’s election interference case in Georgia has issued a protective order that certain “sensitive” evidence in the case be withheld from the public.
The order, issued Wednesday by Superior Court Judge Scott McAfee, came after the video recordings of interviews with some of Trump’s co-defendants were leaked to the media earlier this week.
It specifies that prosecutors can deem certain evidence turned over to the defense as “sensitive material” unfit for public release, and provides that the defense can challenge such a designation within 14 days.
District Attorney Fani Willis had requested a broader version of the order following the leaking of the video interviews, citing potential harassment, witness intimidation, or jury pool tainting.
Defense attorney Jonathan Miller, who represents former Coffee County election supervisor Misty Hampton, admitted to leaking the video evidence, which included excerpts from prosecutor interviews with former Trump attorneys Jenna Ellis and Sidney Powell, as well as pro-Trump lawyer Kenneth Chesebro and Atlanta bail bondsman Scott Hall.
All four have pleaded guilty to charges in the case and agreed to cooperate with prosecutors as they pursue charges against the remaining 15 defendants.

Trump was indicted by Willis in August, and pleaded not guilty to charges related to allegedly attempting to subvert the results of the 2020 presidential election in Georgia, including violation Georgia’s anti-racketeering law.
The Georgia case is one of four pending against the former president, as he also faces charges in New York City, Florida and Washington, D.C.

Former Defense chief says to eradicate Hamas, Iran must be confronted ‘once and for all’
Former Defense Secretary Mark Esper said to defeat the militant Palestinian group Hamas fully, Iran must be confronted “once and for all.”
“[T]o ultimately defeat Hamas, in the extent that we understand it [in] military terms, you have to prevent their ability to reconstitute their military forces,” Esper said in a Thursday interview on CBS.
“To do that, that means you have to deal with Iran once and for all,” Esper continued. “You have to cut off the supply of arms and money and other support. And that’s the bigger issue that we’re not facing.”
At the beginning of last month, U.S. deputy national security adviser Jonathan Finer said Iran was “broadly complicit” in the attack by Hamas that began its current war with Israel. He noted the U.S. rival’s efforts to train and provide Hamas with arms.
“In terms of broad complicity, we are very clear about a role for Iran,” Finer told CBS. “What we have not seen yet at this moment, although we are continuing to look at it very closely, is any sort of direct involvement in the immediate attacks.”
Esper’s comments came on the same day White House national security spokesperson John Kirby said the U.S. is involved in “intense negotiations” to try to secure the release of hostages taken by Hamas amid its conflict with Israel.
“We are in some intense negotiations; hopefully they’ll come out the right way and we’ll have good news to talk about with multiple hostages getting free,” he said. “But we don’t have a deal right now, and until we do, the less said the better.”
