GOP lawmaker targets pro-Hamas protests on college campuses, Dept of Education: ‘Deep rot of antisemitism’
FIRST ON FOX: Republican Congressman Burgess Owens has introduced a resolution condemning the support Hamas has received on college campuses nationwide following its attack on Israel that left over 1,400 citizens dead.
The resolution, supported by dozens of Republican members of Congress, “condemns the support of Hamas, Hezbollah, and other terrorist organizations at institutions of higher education, which may lead to the creation of a hostile environment for Jewish students, faculty, and staff; and urges the Secretary of Education to direct the Office for Civil Rights to investigate and, where appropriate, take action immediately.”
“I never thought I’d see American students celebrate a terrorist organization dedicated to the destruction of Israel and the Jewish people,” the Utah Republican, who chairs the Higher Education and Workforce Development Subcommittee, said in a press release.
“Elite institutions have failed their students and alumni by offering inadequate statements of condemnation. This has exposed the deep rot of antisemitism in our higher education system, from statements placing blame solely on Israel for the atrocities of Hamas to demonstrations glorifying mass murder, rape, torture, and kidnapping. It is not nuanced or difficult to stand against terror.”

The resolution was also signed by Reps. Jim Banks, R-Ind., Elise Stefanik, R-N.Y., Bob Good, R-Va., James Comer, R-Ky., Lauren Boebert, R-Colo., Kat Cammack, R-Fla., Jeff Van Drew, R-N.J., and several others.
“Condemning terrorism should not be a controversial position to take,” Education and the Workforce Committee Chairwoman Virginia Foxx, R-N.C., who also signed the resolution, said in the press release.

“Hamas slaughtered innocent men, women, and children because they were Jewish. It’s appalling that some higher education faculty and students have the gall to defend these despicable actions. I thank Congressman Owens for introducing this resolution to condemn the support of terrorist organizations at colleges and universities that places the safety of Jewish students, faculty, and staff at risk.”
Following the Hamas attack on Israel earlier this month that killed over 1,400 Israelis, protests condemning Israel have erupted on college campuses across the country, including at Harvard University, where calls have intensified for the school’s president to step down over her response to the protests.
“Sadly, there are few places on earth with more vicious antisemitism and hatred of Israel than American ‘elite’ universities,” Texas Sen. Ted Cruz told Fox News Digital in a statement following a letter he sent to Harvard, his alma mater, calling on the school to denounce the protests.
“It’s disgusting, and it’s dangerous. I’m particularly ashamed that student groups from my alma mater, Harvard, blamed Israel for the genocidal war that Hamas terrorists are brutally waging.”
The Department of Education did not immediately respond to a request for comment from Fox News Digital.

Obama issues new statement on Israel and Gaza
Former President Obama issued a new statement Monday on the ongoing violence taking place in Israel and Gaza as the death toll continues to tick up.
In a lengthy statement, Obama again condemned the deadly attacks launched by the militant group Hamas on Oct. 7 in what he called an “unspeakable brutality.” While he maintained Israel had a right to defend itself against the attacks, he reiterated the need to abide by “international law.”
“But even as we support Israel, we should also be clear that how Israel prosecutes this fight against Hamas matters. In particular, it matters — as President Biden has repeatedly emphasized — that Israel’s military strategy abides by international law, including those laws that seek to avoid, to every extent possible, the death or suffering of civilian populations,” Obama wrote.
He said upholding international law is “vital for building alliances and shaping international opinion.” The former president emphasized that doing so is an “enormously difficult task,” noting that military operations “often put civilians at risk.”
The attacks on Israel have resulted in the deaths of thousands of civilians across the region. More than 1,400 Israelis have been killed, mostly in the initial attack launched by Hamas on Oct. 7. The U.S. and other countries have designated Hamas as a terrorist organization.
During the attack, Hamas militants also took more than 200 people hostage during its initial raid on Israel, including many believed to be civilians. At least four hostages have been released so far as officials from multiple countries negotiate for their release.
More than 5,000 Palestinians have been killed so far in the conflict in Gaza, including an estimated 2,055 children and 1,119 women, with more than 15,000 injured, the Gaza Health Ministry reported Monday.
In his statement, Obama warned that a growing humanitarian crisis is underway in the region, citing Israel’s move to cut off crucial supplies to Gaza in the wake of the attacks, which he warned could put support for Israel at risk.
“The Israeli government’s decision to cut off food, water and electricity to a captive civilian population threatens not only to worsen a growing humanitarian crisis; it could further harden Palestinian attitudes for generations, erode global support for Israel, play into the hands of Israel’s enemies, and undermine long term efforts to achieve peace and stability in the region,” he wrote.
Obama concluded his statement by urging people to reject antisemitic, anti-Muslim, anti-Arab and anti-Palestinian sentiments. He also recognized Israel has “every right to exist,” but Palestinians have “also lived in disputed territories for generations.”
“But if we care about keeping open the possibility of peace, security and dignity for future generations of Israeli and Palestinian children — as well as for our own children — then it falls upon all of us to at least make the effort to model, in our own words and actions, the kind of world we want them to inherit,” he concluded.

Trump as House speaker would be the ‘duck-billed platypus’ of politics
Donald Trump is running for president again in 2024.
But there was a brief period earlier this month when the former president was also running for speaker.
Only one person has ever served as both House speaker and president. But certainly not at the same time. James Polk was elected House speaker by his colleagues from 1835 to 1839 while he was a congressman from Tennessee. Later, from 1845 to 1849, Polk served as president.
It was always doubtful Trump would ever become speaker of the House. It was a mathematical impossibility for the former president to win the speakership on the House floor. But amid an astonishing leadership vacuum atop the legislative branch of the United States, it should come as no surprise that some Republicans – and even former President Trump himself – were shopping him as a potential successor to former House Speaker Kevin McCarthy, R-Calif.
HOUSE SPEAKER ‘CHAOS’ COULD BENEFIT DEMS AS RACE STRETCHES INTO NEW WEEK
Rep. Greg Stuebe, R-Fla., advocated for a Trump speakership early on.
Rep. Troy Nehls, R-Texas, quickly announced that he would “nominate Donald J. Trump for speaker of the House” just after the House stripped McCarthy of his gavel earlier this month. Rep. Marjorie Taylor Greene, R-Ga., also pushed Trump for the job.
“I support President Trump because he has a four-year proven record as president,” said Greene, noting she would nominate Trump in the House Republican Conference. “We’re talking about an interim speakership. And I think President Trump is exactly the right outsider for this.”
Let’s establish a couple of facts:
The House has never had a non-member serve as the speaker of the House. But the Constitution and House rules allow for the possibility of non-lawmakers to serve as speaker.

“(These are) unprecedented times and the Constitution allows it. This just not just an ordinary person that we would be bringing in as speaker,” added Greene about Trump.
So someone who is NOT a lawmaker could certainly serve as House speaker. But specifically, what about former President Trump?
Trump is facing trial on multiple felony indictments in various jurisdictions. House Rule XXIII states that members indicted for a crime “which a sentence of two or more years’ imprisonment may be imposed… should step aside from any party caucus or leadership position.”
Note that it says “should.” And the House rule alludes to “caucus” or conference leadership slots. One might be able to argue that doesn’t pertain to the speaker. That’s because the entire House elects the speaker. But Fox is told the “spirit” of the rule applies to the speaker, too. Both the Republicans and Democrats also have internal rules that bar those under felony indictments from serving in leadership posts.
This is one of the reasons why Republicans altered their rules in 2004 to protect then-House Majority Leader Tom DeLay, R-Texas, prior to an indictment on alleged campaign finance violations. But after encountering public blowback, the GOP dropped the rule change. DeLay faced indictment and stepped away from leadership. DeLay was convicted in 2010 but cleared on appeal in 2013.
Regardless, this House “rule” or “guidance” is not self-executing. And if a speaker faced a felony indictment, we’re now well-versed in the mechanisms to remove him or her: move to vacate the chair on the floor.
So, that means former President Trump could serve, regardless of his legal woes.
And so the former president floated his name for speaker shortly after the House showed McCarthy the door.
“All I can say is we’ll do whatever is best for the country and for the Republican Party,” Trump said.
Democrats relished the potential chaos.
“I think Donald Trump is good about inserting himself in any news cycle,” mused Rep. Ro Khanna, D-Calif. “It isn’t going to aid House Republicans.”
Fox even confirmed that Trump planned at one point to attend the House GOP’s “candidate forum” for House speakers – even though he’s not a member of the House nor a member of the House Republican Conference.
“I dare them to keep him out,” warned Greene. “I will nominate him in the conference and President Trump can attend.”
Greene could certainly have nominated the former president. But such a nomination doesn’t guarantee an audience with House Republicans behind closed doors. In fact, a senior House GOP leadership source quickly told Fox that Trump would not be permitted to attend the meeting.
But, like most things in this mid-Congress speaker’s race, everything changed within a few hours.
After Trump suggested he could fill the speaker’s void, the former president endorsed House Judiciary Committee Chairman Jim Jordan, R-Ohio, for the job. Of course, Jordan finally crashed and burned in his bid for speaker after three failed votes on the floor. Jordan bled support on each ballot.
Some political observers wondered if Jordan’s defeat demonstrated a diminishment of support for Trump, considering his sway over House Republicans. Jordan’s spectacular flame-out was a rejection of the pro-MAGA wing of the party and an embarrassment for the former president.
Nehls was beside himself last week after Jordan lost on the floor and Republicans voted by secret ballot to nix the Ohio Republican as their nominee for speaker.

“I don’t think the Lord Jesus Himself could get to 217 (votes) with this conference,” groused Nehls. “So I’m going to start recommending Donald J. Trump as our speaker for 100 days. We could bring him for 100 days. I think it would be fantastic. I think it would show unity.”
But that’s the issue with Trump as a possible speaker.
He could be speaker – but not an actual member of the House.
He could be speaker – but could not vote on the House floor.
He could be speaker – but not a member and thus potentially exempt from House rules that instruct lawmakers not to serve in leadership positions if they face serious criminal charges.
In short, a hypothetical Trump speakership would be the “duck-billed platypus” of politics.
The duck-billed platypus is a mammal. But its classification defies many scientific norms.
The creature has a bill. It features webbed feet and spews venom. Those characteristics aren’t consistent with mammals. That led some 18th-century scientists to question whether the duck-billed platypus was really a reptile – or even some sort of species in transition.
Mammals, ranging from humans to elephants, give birth to their young. The duck-billed platypus lays eggs.
It’s hard to figure out.
And so would a non-member serving as House speaker.
Trump isn’t the only non-member commanding roll call votes for speaker.
Former House Speaker John Boehner, R-Ohio, and former Reps. Lee Zeldin, R-N.Y., and Candice Miller, R-Mich., have also commanded votes on the floor in recent weeks.
But a Trump speakership? It’s unlikely to happen. But like the duckbilled platypus, would be difficult to categorize in political taxonomy.

Republicans accelerate investigation into Biden Cabinet official over ties to left-wing eco group
FIRST ON FOX: Republican leaders on the House Natural Resources Committee are accelerating an ongoing investigation into Interior Secretary Deb Haaland over her ties to left-wing environmental activist group Pueblo Action Alliance (PAA).
According to a letter to Haaland and top Interior Department (DOI) ethics official Heather Gottry — sent Monday and led by Natural Resources Committee Chairman Bruce Westerman, R-Ark. — Haaland has exhibited a potential “lack of impartiality and misuse of her position” for the benefit of PAA and multiple family members. Haaland’s daughter has worked at PAA while her husband has engaged in consulting work related to DOI actions.
“The Committee believes there is evidence that Secretary Haaland may have not acted impartially and did not avoid the appearance of a loss of impartiality in the performance of her duties,” the GOP letter states. “More alarmingly, there is evidence that Secretary Haaland misused her position for the potential benefit of a nonprofit, the Pueblo Action Alliance, and used her position — or at the very least permitted the use of her position, title, and authority — to endorse PAA and PAA’s work.”
“Prior to joining the Biden administration as Secretary of the Interior, Secretary Haaland was evidently involved with the beginnings, and potential origin, of PAA,” it continues. “Additionally, there is evidence that, since becoming Secretary of the Interior, Secretary Haaland has maintained her close relationship with PAA.”
ENERGY GROUP ASKS REPUBLICANS TO INVESTIGATE BIDEN’S INTERIOR SECRETARY OVER ETHICS VIOLATIONS
In June, Westerman announced he would open the investigation into Haaland and her ties to PAA and other interests that may conflict with her official duties. The probe came shortly after she finalized a ban on fossil fuel leasing within 10 miles of the Chaco Culture National Historical Park in New Mexico, a move opposed by local Native Americans and residents, but supported by other tribes and eco groups.
The New Mexico-based PAA previously advocated against new leasing near Chaco Canyon. Haaland’s daughter Somah, in her role as a media organizer for PAA, even lobbied on behalf of the group and against Chaco Canyon leasing during a trip late last year to Washington, D.C.
INTERNAL EMAILS SHOW BIDEN OFFICIALS OPENLY DISAGREED WITH ADMIN’S FOSSIL FUEL POLICIES
The letter additionally pointed to Haaland’s meetings with PAA Executive Director Julia Bernal during her tenure as interior secretary. Bernal boasted during an interview in 2021 that she met personally with Haaland, whom she referenced as “Auntie Deb,” about the group’s broad opposition to oil and gas leasing.
And Natural Resources Republicans have also cited Haaland’s federal ethics disclosures, which show her husband Skip Sayre engages in consulting work for the Laguna Development Corp., a firm that is affiliated with the Laguna Pueblo, an Indigenous tribe. Like the PAA, the tribe has advocated in favor of a buffer zone around Chaco Canyon where new leasing would be banned.
“While a close relationship between Biden cabinet officials and nonprofits is not unique, Secretary Haaland’s longstanding and ongoing intimacy with PAA is,” Westerman’s letter Monday continued. “Thus, the Committee is concerned with Secretary Haaland’s lack of impartiality with matters concerning PAA, as well as the potential for the Secretary to misuse her position for the benefit of PAA.”
“The Committee is also concerned that Secretary Haaland may have conveyed nonpublic information to PAA, whether intentionally or not, given the unrivaled access PAA officials and staff have to Secretary Haaland,” it added.
INSPECTOR GENERAL WARNS BIDEN ADMIN’S $400 BILLION GREEN ENERGY LOAN PROGRAM IS RIPE FOR ABUSE
The letter further noted PAA has engaged in collaborations with the All-African People’s Revolutionary Party, a group fighting for the “unification of Africa under an All-African Socialist Government,” and the Venceremos Brigade, a group established with the assistance of the Cuban government’s intelligence agency and that advocates for policies in “solidarity with the Cuban Revolution.”
“Since the July 2019 trip to Cuba, the All-African People’s Revolutionary Party, the Venceremos Brigade, and PAA have continued to work together on shared projects and goals, including the creation of a New Mexico-based chapter of the Venceremos Brigade,” the Republicans wrote.
The Republicans asked for a series of communications and documentation related to the investigation. They also asked again for documents requested in June that DOI has yet to provide.
Rep. Paul Gosar, R-Ariz., the chairman of the Natural Resources Subcommittee on Oversight and Investigations, co-signed the letter Monday with Westerman.
The DOI and PAA didn’t immediately respond to requests for comment.

Biden says ‘we can talk’ about Israel-Hamas cease-fire after hostages are released
President Biden said Monday that he would be willing to engage in talks about a cease-fire between Israel and Hamas if the hostages taken by the militant group were released.
In response to a question by a reporter about whether the U.S. would support a potential cease-fire for a hostages deal, Biden replied: “We should have those hostages released, and then we can talk.”
Among the more than 200 hostages taken during the Oct. 7 attack by Hamas are a contingent of Americans that the U.S. has been attempting to free. Two of those Americans were released last week by Hamas in a deal brokered by Qatar. On Monday, right around the time Biden made his remark, two more hostages were released, The Associated Press reported, citing the International Committee of the Red Cross.
National security spokesperson John Kirby said Monday that a handful of Americans are still being detained as hostages, while more than 10 Americans remain unaccounted for.
The White House has been sidestepping questions on whether it was asking Israel to delay its expected ground invasion after reports suggested it was doing so in the hopes that more hostages would be released.
Biden’s comment came after he had finished remarks on new regional tech hubs and turned the event over to Commerce Secretary Gina Raimondo, saying he had to go to the Situation Room for “another issue that I have to deal with.”
Biden also answered a question about a call he had with Pope Francis on Sunday, saying the two are on the same page about the latest developments in Israel and Gaza.
“He was very, very interested in what we were doing to deal with some of the crises we’re facing, particularly in Israel this time around. And I laid out to him what the game plan was, how we thought we should be providing the kind of assistance to Israel they needed,” Biden said. “And, the Pope was across-the-board supportive of what we’re doing.”
Israeli forces have been striking Gaza by air since Hamas launched attacks that killed more than 1,400 people in Israel, including hundreds of civilians in their homes, at a bus stop and at a music festival Oct. 7.
The Israeli bombardment of Gaza has so far killed more than 5,000 Palestinians and injured more than 14,000 others. Israel has also cut off food, water, electricity and medicine to the region, intensifying the humanitarian crisis in the area.

New York GOP lawmakers accuse state education board of pushing antisemitic material to kids
FIRST ON FOX – Ten Republican U.S. House members representing New York say the state department of education is pushing misleading anti-Israel messages on children through teacher materials.
In a letter to Education Department (NYSED) Chancellor Lester Young Jr. and Commissioner Betty Rosa, Rep. Claudia Tenney, R-N.Y., and the GOP delegation from New York called out a video and training materials linked from a government website designed to help educators teach children about the war in Israel following Hamas’ deadly terror attacks.
Since the department shared the video, New York lawmakers said they “have had numerous parents, Jewish educators, Rabbis, and community leaders reach out to our offices to express outrage over the NYSED’s endorsement of these resources,” according to the letter obtained by Fox News Digital.
ISRAEL REMAINS POISED FOR GAZA INVASION AS AIRSTRIKES ON HAMAS CONTINUE
The lawmakers claim an article about the conflict and a short video produced by Canadian news outlet CBC contain numerous factual errors, as well as antisemetic and anti-Zionist biases, that paint Israel as the primary aggressor in the decades-long conflict.
“This article and video are not only factually inaccurate and lack requisite context, but are clearly biased against Israel. Sadly, this appears to be representative of the pervasive anti-Semitic and anti-Zionist material that emanates from your offices,” the letter states.
The lawmakers claim the video overlooks key context of the decades-long conflict by stating that the issue is merely about land, pointing out that Israel has offered “numerous land-for-peace deals” that Palestinian leaders have rejected over the years.
“While we fully appreciate the need to simplify things when educating our children, this video leaves out critical context, without which, one cannot even begin to have a dialogue about the Israeli-Palestinian conflict,” the letter says.
Israel is in its third week of war against Hamas in Gaza following the terrorist group’s attack on Oct. 7. In the weeks since the attack, pro-Palestinian demonstrations at college campuses have been criticized for supporting terrorist organizations and using antisemitic speech.
HOUSE GOP DEMANDS PROBE INTO ‘ANTISEMITIC’ NEW YORK EXAM QUESTION’S ‘REVISION’ OF HISTORY ON ISRAEL
The CBC Kids video, which appears in a list of resources shared by NYSED, states that the Israel-Palestinian conflict is “about one thing: land,” which the lawmakers say is a gross mischaracterization.
“This notion glosses over the true essence of the conflict, which is the desire of Hamas, Palestinian Islamic Jihad, the Popular Front for the Liberation of Palestine, and their supporters to wipe out Israel and the Jews, whereas Israel is fighting for the right of it and the Jewish people to exist,” the lawmakers wrote.
“This is not merely about land, but the right to exist. This is made clear by the mainstream Palestinian chant of ‘From the [Jordan] river to the [Mediterranean] sea,’ implying the lack of existence of a Jewish state entirely,” the letter says.
The lawmakers also took issue with what they called a false equivocation of Israel’s government and Hamas. The video shared by NYSED stated, “Both sides have used violence to protect themselves.”
“While Israel regularly aims to mitigate civilian casualties by dropping leaflets, evacuation orders, and performing roof knocks prior to raids, Palestinian leadership almost exclusively targets civilians. In the most recent example, Hamas broadcasted videos of its soldiers murdering, beheading, raping, torturing, kidnapping, and brutalizing children, women, and the elderly. This includes numerous Americans,” the lawmakers wrote.
In addition to Tenney, the letter was also signed by Republican New York Reps. Elise Stefanik, Nicholas Langworthy, Andrew Garbarino, Mike Lawler, Anthony D’Esposito, Marcus Molinaro, Nick LaLota, Brandon Williams and Nicole Malliotakis.

GOP Sen. Ted Budd demands State Department roll back requirement for employees to use preferred pronouns
FIRST ON FOX: Sen. Ted Budd, R-N.C., is demanding the U.S. State Department rescind its requirement that employees use preferred pronouns and honorifics in the workplace.
In August, the department rolled out new guidelines titled, “Updated Department Guidance Regarding Transgender Employees in the Workplace” and mandates that all employees and applicants should be addressed “by the name, pronouns, and honorific (Mr., Mrs., Ms., Miss, Mx., etc.) that they themselves use in everyday interactions, and as they choose to communicate to their supervisor/manager and colleagues.”
“Continued intentional use of an incorrect name, pronoun, and/or honorific – also known as misgendering – could, depending on its severity and pervasiveness, contribute to a hostile work environment allegation, and constitute misconduct subject to disciplinary action, up to and including separation or removal,” the guideline states.

In the letter, Budd contended that Congress “never authorized” the department to “impose such restrictions on employee speech” and that several senators with religious convictions have voiced their concerns “stating that they cannot comply with this Guidance without violating their religious beliefs.”
“But even if Congress did so, this Guidance would be arguably unconstitutional. Specifically, this Guidance infringes upon the First Amendment rights of State Department employees, as recognized by the Supreme Court, to speak openly on matters of public concern and to be free from government compelled speech, including government-compelled affirmation of contested political, social, and
religious ideas,” Budd wrote Friday.
By Nov. 3, Budd wants State Department Secretary Antony Blinken to provide answers on the legal authority behind the guidance, potential exceptions based on religious or non-religious grounds, the process for employees to request exceptions, efforts made to inform employees about this process, and measures to prevent retaliation or mistreatment.
PARENTAL DISCLOSURE REQUIREMENTS FOR SEX ED, GENDER IDENTITY CLEAR OHIO HOUSE
udd asked the department to justify — if there are no exceptions whether religious or non-religious — how this guidance aligns with the First Amendment. And he is seeking detailed information on the disciplinary process for alleged violations and the standards used to determine the seriousness of violations.
“As Secretary Blinken has said, ‘When religious liberty is at risk,’ then ‘other freedoms are jeopardized as well.’ By threatening State Department employees with termination simply because they seek to live according to their beliefs, this guidance jeopardizes the freedom of religion and the freedom of speech – including the freedom not to speak – of all State Department employees,” Budd told Fox News Digital in a statement. “I call on Secretary Blinken to publicly and immediately rescind this guidance so that State Department employees can do their vital work in this time of crisis without being in fear of losing their job.”

Border Patrol clocking 1,000 ‘known gotaways’ per day, over 23K people in October, CBP sources say
U.S. Customs and Border Protection (CBP) sources confirmed to Fox News that there have been more than 23,000 “known gotaways” since the new fiscal year began on Oct. 1.
That means more than 1,000 individuals were seen or detected by Border Patrol agents but not apprehended per day this month.
Sources say figures like these representing the rate at which people are crossing illegally and disappearing into the interior are keeping border officials up at night because American authorities have no idea who these estimated 1,000 individuals coming over each day are, where they are from or why they are coming here illegally.
Meanwhile, a new monthly update released Saturday by the CBP showed border officials arrested 18 people on the FBI’s terror watchlist in September, making fiscal year 2023 a record year for such encounters at the southern border.

According to CBP statistics, 169 people on the FBI terror watchlist were encountered between ports of entry at the southern border in the past 12 months, a number that exceeds not only the previous fiscal year’s record-setting total (98) but the last six fiscal years combined.

In September, the U.S. Border Patrol recorded 218,763 encounters between ports of entry along the southwest border, according to the report.
“In response to high rates of encounters across the southwest border in September, CBP surged resources and personnel. We are continually engaging with domestic and foreign partners to address historic hemispheric migration, including large migrant groups traveling on freight trains, and to enforce consequences including by preparing for direct repatriations to Venezuela,” Troy A. Miller, Senior Official Performing the Duties of the Commissioner, said in a statement.
“CBP will continue to remain vigilant, making operational adjustments as necessary and enforcing consequences under U.S. immigration law,” Miller said. “The supplemental funding request announced yesterday would provide critically needed additional resources including additional CBP agents and officers to support our essential missions: from border and migration management, to countering fentanyl and keeping dangerous drugs out of our communities.”
